Yippee!
I may have more to say on this later, but it’s been a very busy morning day and I’m exhausted. Happy, joyful, ecstatic, gleeful and proud, but exhausted. Trying to skim the 120-page decision while sitting in the green room at KPBS (after our show, thank gawd) and talk semi-intelligently about today’s ruling in In Re Marriage Cases just brought back flashbacks to law school and the dangers of last-minute “reading.” Issue, issue, issue, rule, rule, rule, analysis, analysis, analysis, is this it, more analysis, ah finally, conclusion at page 120. Hopefully I didn’t step on it too bad. More specifically, hopefully the video Trina was shooting never sees the light of day.



Being the lawyerly type, Chuck, can you tell us if this will have any effect on overturning Federal laws?
I don’t understand the dissenting opinions of Baxter and Chin. They take the stand that every voter-approved initiative is awesome (or the 1979 law) and can’t be overturned. If the law’s bad, ditch it.

Darren – no direct effect on overturning the federal laws, but hopefully some influential weight in pushing leaders into making the changes. I have to admit I’ve only skimmed the opinions myself (176 pages), but on the surface I don’t get the dissents either.
It seems rational, and strengthens my own “nationalist” identification as “Californian.”
I wonder if it will stand if it goes to referendum or whatever. I’ll be sure to vote yes.
Leah’s brother is coming to stay with us with his family — he’s going to sit for the bar, supposedly — I expect him to be appalled by this decision. :-\
Even if the silly referendum effort has enough legitimate signatures, I’m pretty certain this will stand. I don’t think November will be a good election for the so-called conservatives of the religious right in any way, shape or form.

Joe – as to the brother, I hope he doesn’t take the path of the Massachusetts applicant a few years back who sued the bar because a gay marriage question offended his sensibilities. Your personal viewpoints have no bearing on knowing what the law is and isn’t. I’ll admit there are lots of laws on the books that I think are pretty worthless (or worse).
